If paid by Wire Transfer, purchaser will be responsible for all wire transfer fees.
If purchaser is an internet buyer, the down payment must be received by Elmore Realty & Auction within 48 hours from the date of sale. We DO NOT accept credit or debit card payments as a down payment on real estate.
The balance of the purchase price is due at closing (in 30 days or less).

Property sold is without contingencies of any type such as inspections, financing, usability, etc...

CLOSING: The closing of the transaction SHALL OCCUR WITHIN 30 DAYS OR LESS from the date of the real estate contract (day of sale).
TAXES: 2021 Property Taxes shall be prorated as of closing date.
POSSESSION: Possession shall be given upon delivery of deed, at closing.
INSURANCE: Insurance on property will be carried by the seller until closing.

LEAD BASED PAINT: The residence was built prior to 1978 and may contain lead based paint. Purchaser will be required to sign a lead based paint waiver day of sale, waiving any further inspections.
INSPECTION: You may view the property prior to the auction sale by appointment only with Elmore Realty & Auction. We advise prospective purchasers to view the property and inspect the property to your satisfaction.

Buyer &/or Bidder agrees to hold harmless & indemnify Elmore Realty & Auction and it's Agents & Representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc...
ANY QUALIFIED BIDDER, INCLUDING THE AUCTIONEER AND ANY OF THE AUCTIONEER'S AGENTS MAY BID. THE AUCTIONEER MAY, BY KENTUCKY LAW, REJECT THE BID FROM ANY BIDDER DEEMED UNFIT OR UNQUALIFIED TO BID.
BIDDING INCREMENTS: The Auctioneer will determine bididng increments, which may be changed during the auction sale at Auctioneer's discretion.
END TIMES: Elmore Realty & Auction's online auctions are timed events and all bidding will close at a specified time. Our online auctions also have an automatic extension in the final 10 minutes of an auction.
IF a bid is placed in the final 10 minutes, the closing time on that lot will automatically extend 10 minutes. The lot remains open until no further bids are received.
KEEP REFRESHING YOUR SCREEN DURING THE CLOSING MINUTES.
SOFTWARE & TECHNICAL ISSUES:
If technical difficulties are experienced, Elmore Realty & Auction reserves the right to continue the bidding, extend the bidding OR close the bidding at Auctioneer's discretion.
NEITHER ELMORE REALTY & AUCTION NOR THE COMPANY PROVIDING THE SOFTWARE SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. EMAIL NOTIFICATIONS WILL BE SENT TO REGISTERED BIDDERS WITH UPDATED INFORMATION AS DEEMED REASONABLE BY ELMORE REALTY & AUCTION.
A winning bidder who does not execute the real estate sales contract and return within 24 hours of auction's conclusion with the earnest money deposit will be considered in DEFAULT.
If a winning bidder fails to submit the signed contract along with the earnest money deposit within the allotted time, the winning bidder will be charged a penalty of 20% of the winning bid.
All legal remedies available may be used to collect these charges.
Additional remedies are reserved by Elmore Realty & Auction and the Seller as provided in the Real Estate Sales Contract and the Terms and Conditions of Sale.
Elmore Realty & Auction reserves the right to sell to the second highest bidder in the event the successful high bidder does not comply with the terms of the sale.
